Judge Rules in Favor of H.H. Knoebel Solar Project – wkok.com

SUNBURY – The News Item is reporting…  A Northumberland County judge has ruled that H.H. Knoebel Sons Inc. can construct and use a major solar power generation facility on 10 of 15 acres of land near Monastery Road and Route 487.

Judge Hugh A. Jones recently issued the ruling in the civil action the company filed against the Ralpho Township Board of Supervisors last December over a solar energy ordinance the supervisors adopted in November.

The ordinance amended a pre-existing zoning ordinance by adding definitions of solar energy systems, permitting minor solar energy systems in any zoning district and major solar energy systems in agricultural-forest district by special exception.

In his June 18 decision, Jones stated that the interpretation of the language of the zoning ordinance clearly led the court to conclude that the ordinance at the time of Knoebels’ application was exclusionary and therefore unconstitutional.
