A state incentive program for solar farm expansion will be limited to up to 5% of any New Jersey county’s preserved farmland, a state appellate court ruled.

A coalition of developers can’t rely on another part of the state’s incentive program that allows up to 2.5% of state farmland to qualify while ignoring county caps, the New Jersey Superior Court Appellate Division ruled Tuesday. Siding with the energy companies would potentially wipe out all of the best agricultural resources in smaller counties, the court said.
